Terms and Conditions of Use for the eLeSI Platform

Preamble

The Terms and Conditions of Use herein apply without restriction or reservation to the entire set of services proposed by e‑Learning pour une Société Inclusive (eLeSI) on its platform elearning.elesi.eu (the "Platform").

These terms and conditions apply, to the exclusion of any other conditions, from the time the user registers via the online elearning.elesi.eu Platform.

Registration on the Platform and/or use of the Platform constitutes unconditional acceptance of the Terms and Conditions of Use herein.

Article 1 – Registration and acceptance of the Terms and Conditions of Use by users

Registration for the services of the eLeSI Platform is done directly via the elearning.elesi.eu website. 
Users must create a personal account before they can use the services proposed by the eLeSI Platform.

Future users of the eLeSI Platform are asked to provide personal information that is required before the training services offered by the Platform can be used.
The data that must be supplied to open an account are: a user name (login), a password, family name and given name, city and country of residence, and a valid e-mail address. 
When the user account is created the user is asked to choose a password to ensure that the personal information recorded for the account remains confidential. Accordingly the user agrees to refrain from communicating this password to any third party whatsoever. In the event that a user password is communicated by the user to a third party, eLeSI shall in no way be responsible for unauthorized access to the user account.
 The user must validate registration by clicking on the "Create my account" button.

The user will receive an email confirming the registration. In clicking on the confirmation of registration link that appears in the email the user acknowledges having read and accepted the Terms and Conditions of Use. If this confirmation email is not received within 24 hours the user should check the "spam" folder of the email application for this message. If the email is not received, the user should contact the eLeSI publisher via the elearning.elesi.eu Platform, for it is possible that the registration was not recorded for technical reasons.

The user pledges to supply true and accurate information. Furthermore, the user agrees to regularly update the information communicated at the time of registration, and to inform the Platform publisher without delay of any changes that might affect the continuation of the user's status as a user member of the eLeSI Platform. 
The publisher of the elearning.elesi.eu Platform expressly reserves the right to cancel the account of any user who fails to comply with the Terms and Conditions of Use herein, and in particular of any user who communicates false information at the time of registration or when using the account, or if the account remains inactive for nine months or.

By registering on the eLeSI Platform the user, whether a physical or moral person, agrees to be bound by the Terms and Conditions of Use herein, and explicitly acknowledges full acceptance of these conditions. The user renounces the right to have recourse to any document in contradiction to these terms that might be opposed to the publisher of the elearning.elesi.eu Platform.

Article 2 – Access to information on the eLeSI Platform

After validation of registration by the publisher of the elearning.elesi.eu Platform, the users will have access to their personal information via their user name and personal password.
Each user can post a personal profile, including any personal information that the user wants to share with other users.
The training on the eLeSI Platform is offered free of charge and made available online for the purpose of improving support practices and the inclusion of persons with intellectual impairments, learning disabilities, autism spectrum disorders and/or mental health problems.

The training and certificates delivered in this framework are not eligible for European Credit Transfer and Accumulation System (ECTS) or university course credits. The identity of the persons registered as users is not verified by the eLeSI consortium partners who provide the training course.

Article 3 – Special conditions applicable to registered learners

Once the user has clicked on the registration confirmation in the email sent to this effect, the registration on the elearning.elesi.eu Platform cannot be cancelled by the learner.

Registration of the learner for services on the eLeSI Platform will not be definitive until the learner sends a confirmation email to validate the registration. By this validation the user accepts the Terms and Conditions of Use herein.

Right of withdrawal: In keeping with article L 121-20 of the Consumer Code (France) there is a waiting period of 15 working days during which the learner can cancel his/her registration. The waiting period starts with the first access to training modules on the elearning.elesi.eu website.
Cancellation must mandatorily be notified to the publisher of the Platform via the contact page on the elearning.elesi.eu website. The user name (login) and email address entered at the time of registration must be given.

As soon as the publisher receives notification of cancellation, within the 15-day waiting period from registration, the publisher of the elearning.elesi.eu Platform will immediately cut off access to the training modules on the website for the user.

Article 4 – Responsibility

In addition to training tools made available to users, the Platform facilitates communication between users, via a Facebook group, Skype, internal forum, email, among others. The publisher and moderators of the Platform do not verify the accuracy, authenticity or completeness of the messages posted via these communication platforms. It is therefore the users' responsibility to exercise prudence and good judgement when corresponding with other users. The users agree to show respect for the other users at all times in the content and commentaries posted.

In the event of technical malfunction of the elearning.elesi.eu Platform, the publisher and host of the Platform will take all necessary measures to reinstate the Platform's functions, upon notification by the user(s).

The publisher of this Platform reserves the right to modify or amend the content of the documents published on the Platform, at any time and without prior notification. The publisher declines all responsibility for any inaccuracy, error or omission contained in the information available on the Platform. The publisher cannot be held responsible for any technical difficulties encountered on the Platform website, or on any other website to which the user is directed via hyperlinks from the platform, or from which users are directed to the elearning.elesi.eu Platform. More broadly the publisher declines all responsibility for any loss, harm or damage, direct or indirect, whatever the cause, origin, nature or consequences thereof, that might ensue from access to the Platform, or inability to access the Platform, by any user or would-be user, and/or from use of the Platform, and/or from reliance on or merits attributed to any information whatsoever obtained directly or indirectly via the Platform.

The publisher of eLeSI cannot be held responsible or liable for any delay or non-execution in the case of force majeure as habitually recognized by French jurisprudence.

Article 5 – Evaluation of Users

Pre- and post-tests and quizzes contained in the platform modules are graded. The grades attributed are available only to the individual learner, to the teaching team and/or the tutors who accompany the individual learner.

Article 6 – Information Technology and Data Protection

In compliance with French Law 78-17 of 6 January 1978, it is hereby stated that the personal data requested of users of the Platform are necessary for recording their registration.
The storage and processing of the information submitted to the elearning.elesi.eu Platform have been notified to the French Commission Nationale de l'Informatique et des Libertés (CNIL) via the CNIL correspondent of the elearning.elesi.eu Platform. The publisher of the Platform pledges that user data will not be communicated to third parties other than the partners in the eLeSI project.
Users can at all times access, view, modify, rectify or have removed their personal data, in keeping with current national and European regulations. Users may exercise this right via the contact page of the elearning.elesi.eu Platform.

Article 7 – Intellectual property

Content posted on the eLeSI Platform: The content of the Platform website and of associated printed materials is the property of the eLeSI consortium, and is protected by French and international intellectual property law. Members of the consortium are: Fondation des Amis de l’Atelier (France) – Coordinator; University of Chester (United Kingdom) – Content provider; University of Mons (Belgium) – Content provider; INS HEA (France) – Content provider; Association Alternativa 2003 (Romania ) - Contributor; Association Miwadagbé (Bénin) - Contributor; University of Fribourg (Switzerland) - Associated partner.

This content has been registered in toto with the Institut National de Propriété Industrielle (INPI) in France.

The mark eLeSI and the associated logo have been registered under the number 012508602 with the Office for Harmonization in the Internal Market (OHIM), an agency of the European Union; this registration includes registration with INPI in France.

Any reproduction, use and/or modification, as well as downloading, representation, dissemination, adaptation, translation and/or transformation, in full or in part, of the content of the Platform, or transfer to another website or any other medium (printed paper, digital, film, etc.), for purposes other than personal and private non-commercial use, without the prior written consent of the publisher of eLeSI, is strictly forbidden.

All graphic elements, images, pictures, photographs, illustrations, texts, diagrams, animated sequences with or without sound accompaniment, all soundtracks and musical components, logos, marks, product names, the content, title, design and form of the Platform website, its graphic design charter; all the content including but not limited to exercises and the corresponding answers, the questions and answers database, tests, glossaries, recorded dialogue, and their organization; all compilation of software, fundamental source code, software applications (including applets) that constitute the Platform website or are represented on the Platform website are protected under intellectual property law, and are, depending on the case, the property of the eLeSI consortium, of Moodle, or of third parties who have authorized their representation by the publisher eLeSI on the Platform website.

Article 8 – Applicable law – Languages – Disputes

It is expressly consented by the parties that the present agreement is governed by French law. The agreement is drawn up in French. Should it be translated into another language or languages, only the original French text shall prevail in the event of dispute or litigation.

Any dispute arising from the present agreement, with reference to its validity, interpretation, execution, termination, consequences or their effects, shall be submitted to the competent courts of law in keeping with the provisions of common law. In the event of litigation involving professionals and or commercial entities, the administrative court of Cergy-Pontoise is the competent jurisdiction.
